Licensing
What royalty rate can a first-time licensor realistically get?
The short answer
Anchor at the data, not the anecdotes: 65% of all royalty rates are 5% or less, and 90% are 10% or less. A first-time licensor with a solid patent should expect to negotiate in the low single digits — and remember that 3% of a big market beats 10% of a small one.
The full picture
What moves you within (or above) the band: industry norms (RoyaltySource's 30-year benchmarks run from 4.3% medians in semiconductors to 6.1% in medical/telecom), how much of the product's value your invention represents, your evidence of use, and how badly the licensee needs freedom to operate. Rates above 15% exist but are rare — extraordinary technologies, gaming, entertainment.
First-timers lose money two ways: asking for a fantasy rate that ends conversations, or accepting the first offer because any number feels like winning. The fix is the same — walk in with benchmark data for your industry and a structured view of your patent's strength. That's a standard part of our score, and it pays for itself in the first negotiation.
